7. If a tree branch falls onto a neighbor’s land, does the owner have the obligation to remove the branch and pay for the damage?

There are two typical reasons why tree branches fall, and the law treats the two of them differently. The first reason is because the tree (or just the branch) was diseased or dead. Th second reason is because a storm or other unusual weather broke a healthy branch off the tree or uprooted the entire tree. The law usually handles these two situations differently, as we’ll explain in the next couple of sections.
